I have posted previous articles about the post-crash investigation an accident victim should do. My tips included obtaining insurance information from all involved drivers. I cannot stress enough how important it is to obtain the other driver’s insurance information. This is also the case for pedestrian accidents: If you were hit as pedestrian or bicyclist by a vehicle, it is just as important to obtain the driver’s insurance information. This is because insurance companies make it easy to start bodily injury claims. Insurance companies are in the business of starting, investigating, managing and paying claims.
Insurance companies are honest about whether they insure particular drivers. They will likely pay claims that are legitimate. Thus, an attorney evaluating a personal injury case will be more inclined to accept the case when the accident victim can produce the other driver’s insurance information.
If, for example, the accident victim only has the other driver’s name and cell phone number, the evaluating attorney will have to do more work to determine (1) who insured the driver, and (2) whether there is any insurance applicable to the accident. Insurance companies have a duty to provide this information. And arguably, so do their insured drivers, but drivers are not always as cooperative disclosing information in the days and weeks after an accident as insurance companies. Some drivers may “go off the grid” to shirk their responsibility to their victims, while insurance companies will not do this because they are susceptible to bad faith claims and are public companies.
Thus, if you are in a car, truck or motorcycle accident, do your best to get the insurance information of the other driver. You will be in a better position to get your claim resolved. An accident attorney will more likely accept your case and represent you, when you have already obtained the necessary insurance information to start your claim.
