Don’t Fail to Keep Your Attorney Informed

An attorney partly relies on his clients to keep him informed of important facts about their cases. These facts also include developments in the weeks, months and sometime years after an accident.

If you are a party in a personal injury case, you will provide a lot of the evidence that your attorney will use to prosecute (pursue) your claim. In fact, your body is part of the evidence. Consequently, if you begin to experience new symptoms after an accident, it is important to let both your doctors and attorney know. For instance, you may begin to develop Post Traumatic Stress Disorder (PTSD) after an accident. This can happen as a result of the traumatic experience of the accident itself and the stress of dealing with the injury in the weeks and months after the accident. However, to pursue a PTSD claim, it must be diagnosed by a mental health professional, like a psychiatrist. Your attorney can help make sure that you are treated by a mental health professional.

It is important that your attorney also be advised of important changes or events in your life after an accident. For instance, you should advise your attorney if you file for bankruptcy; file for disability; are involved in another accident; file for workers’ compensation; are arrested; or, move your residence. All of these types of changes or events can have an impact on your case. So, your attorney should be made aware. Your attorney will advise you how and why these events impact your case.

You should have regular contact with your attorney throughout your case. I touch base with each of my personal injury clients at least three to four times a month. Furthermore, I schedule a formal status with each of my clients at least every sixty days. This facilitates a good rapport between my clients and me. It also keeps lines of communication open and reinforces their trust in me.

Do not make the mistake of failing to disclose something to your attorney because you think it will hurt your case. To do so, may kill your case in certain circumstances. And in most cases if it is something significant the defendant insurance company will likely have a way to find out the information on its own. You are better served by informing your attorney of all information that may impact your case. Your attorney will know the best way to handle the information and what strategies to employ to minimize the impact of damaging evidence or information.

The rule of thumb: If you think you have information that may impact your case, tell your attorney. Play it safe. Do not try to figure out on your own what your attorney needs to hear. Your attorney is best suited to determine the impact the information will have.
